General terms and Conditions

The general terms and conditions listed herein are part of any contract concluded between the company's canoe travel Lutz Berger | Lutz paddelt!; Inh.: Lutz Berger, Turkish break 25, 47809 Krefeld (hereinafter referred to as Lutz-paddled) and comes to you as an event participant.

1. Registration and conclusion of the contract

  1. The registration for the events can be made in writing, by post or e-mail and represents a binding offer of the event participant which is valid for four weeks. This application must be made via a booking form (online or by post or by mail). Informal bookings are also recognized as soon as they have been confirmed by Lutz-paddling in writing or orally.
  2. Lutz-Paddling accepts the booking in the form of a booking confirmation. This can be done orally or in writing. Upon conclusion of the contract, the event participant will generally receive a written confirmation of the booking and other event documents. However, if the booking confirmation differs from the offer of the event participant, this is a 14-day offer from Lutz-paddled and can be accepted by payment of the deposit.
  3. If several participants are registered in a registration, the notifying Party shall be liable for all obligations of the latter.
  4. Our prices are always connected with an additional (per group, per person or per event duration, per day). This varies depending on the event and can be retrieved from the brochures or the offer of Lutz-paddles. Age-related benefits always refer to the completed year of life.
  5. The organiser has the right to have individual events performed by a partner. In this case, Lutz-paddles only acts as a travel agent and the terms and conditions of the partner company are valid.
  6. Lutz-paddling is not a tour operator ISD § 651a BGB and is therefore not obligated to offer travel security certificates and a travel cancellation insurance.

2. Terms of payment

  1. For events up to 100, 00 euro, these must be paid within 30 days after receipt of the booking confirmation/invoice.
  2. In the case of amounts for events starting at 100.00 Euro, a deposit of 25% of the total event price will be payable within 30 days after receipt of the booking confirmation/invoice. The balance is payable, unless otherwise agreed, no later than 31 days before the start of the event.
  3. Payment is made by means of payment options offered. The participant name and the invoice number must be specified. Transfers are made to Lutz Berger; Iban No.: DE27 3205 0000 0000 3523 51; BIC: SPKRDE33XXX; Sparkasse Krefeld.
  4. If the balance is not received in time on the account, the contract can be terminated after a one-time reminder and deadline. In this case, the participant will be charged with cancellation costs (see 3.1).
  5. For bookings made from 31 days before the start of the event, the total amount will be due immediately after the booking confirmation and must be paid at the latest immediately before the start of the event.
  6. When using a Frühzahlerrabattes, the total amount must be credited to Lutz-paddles within 7 days after the invoice has been created. If this is not the case, the Frühzahlerrabatt is disapproved and the difference is invoiced to the participant.
3. Withdrawal or rebooking by the participant
  1. The event participant can withdraw from the event at any time. This must always be done in writing. The cancellation costs incurred will be at least 25.00 euro and shall be calculated as follows:
    • After cancellation up to 31 days before the start of the event 20% of the total costs
    • Up to 22 days before the start of the event 30% of total costs
    • Up to 15 days before the start of the event 50% of the total cost
    • Up to 8 days before the start of the event 80% of the total cost
    • Up to 1 day before the start of the event 90% of the total cost
    • On the day of arrival or later 100% of the total cost
  2. The transfer of an event after the booking to a different date is in principle only possible after written or verbal agreement with Lutz-paddling. It will be effective only after written confirmation, by email or by post, by Lutz-paddling. There is no entitlement to a rebooking, it is at the discretion of Lutz-paddles and is a goodwill for which a handling fee is payable in the above-mentioned amount:
    • For domestic events:
      At least 10,-Euro per transfer
    • For international events:
      At least 25,-Euro per transfer

4. Services not used

  1. If benefits are not claimed due to illness, early departure or other reasons not to be used by Lutz paddlers, there is no entitlement to reimbursement of the event costs. Expenses saved by Lutz-paddled by third parties will be refunded to the event participant.

5. Resignation and termination by Lutz-paddles

  1. Disturbance during the event:
    An event can be terminated without notice if the event participant continues to disturb the Schedule of the event even after a warning. Immediate exclusion is also possible if the event participant endangers the group or does not comply with clear instructions from the event attendant. Lutz-paddling reserves the right to the total price of the event. Saved expenses, credited services of third parties or benefits drawn from this event will be credited to the event participant.
  2. Non-compliance with the participant's requirements:
    With the booking, the event participant accepts the conditions for participation in the booked event. These are included in the description of the event. An event can be terminated without notice if the event participant does not meet the requirements. Lutz-paddling reserves the right to the total price of the event. Saved expenses, credited services of third parties or benefits drawn from this event will be credited to the event participant. If a change in an event adapted to the requirements of the participant is possible on the spot and at the same time, without the disadvantage of the other event participant, Lutz-paddles offers this. There is no entitlement to this change, it is at the discretion of Lutz-paddles and represents a goodwill.
  3. Minimum number:
    If the minimum number of participants in an event is not reached, lutz-paddles can cancel these 7 days before the start of the event. It is at the discretion of the organiser whether the number of participants is sufficient. A replacement for the failing event may be required if it is not associated with any additional expenses for Lutz paddlers.
6. Benefits/Changes in performance
  1. The services result from the individual event descriptions or a written offer by Lutz-paddles in connection with the booking confirmation.
  2. In case of significant changes in the services, the event participant may withdraw from the event or take advantage of a replacement event. However, this right must be exercised immediately when the change is made known.
  3. Changes in performance that remain within a reasonable framework, are not wilfully caused by Lutz paddlers and are not a significant deviation are permitted. However, these are to be communicated to the event participant immediately upon becoming known.
  4. If, at the request of the event participant, changes are made to the event, they may be linked to a rebooking fee. The amount of the rebooking fee is determined according to the expenses.
  5. If a call for proposals indicates possible problems (e.g. fluctuating water levels of different rivers such as the victory), Lutz-paddling can show alternatives at the conclusion of the contract. If an alternative is agreed, it is binding.

7. Force Majeure

  1. In case of unforeseeable force majeure (floods, thunderstorms in canoeing events, etc.), which significantly disrupt or endanger the event, Lutz-Paddlet can propose an alternative programme or cancel the event.
  2. The event participant can also cancel the contract in this case.
  3. Lutz-paddling can claim compensation for services already rendered or to be performed.
8. Liability
  1. Events associated with special risks are at your own risk. We are only liable in case of gross negligence and intent on the part of the organizer. The participant is aware that he is taking part in an event with a sports equipment on the water and assures that he can swim.
  2. For damages that are not bodily damage, the liability of the organizer is limited to the triple event price, if the damage was not caused by gross negligence or wilful intent.
  3. Lutz-paddling is not liable for performance disturbances or damages which are marked in the prospectus, webshop or in the offer as third-party services and have only been mediated.
  4. The participant is liable in case of loss or defect for the rental material from the time of delivery. Defects must be immediately displayed.

9. Customs, passport and other provisions for the event area

  1. The event participant has to ensure that there are special provisions on customs, foreign exchange, visas, passports, etc. depending on the venue. The event participant is responsible for the observance of all provisions, including those not mentioned by us. All the disadvantages arising therefrom are at his own expense.

10. Contract Obligation and notices

  1. Should an event not be carried out according to the contract or if defects occur during the booked event, they shall be immediately forwarded to the event management or lutz-paddling (Lutz Berger, Turkish break 25, 47809 Krefeld, tel.: 49 (0) 163 727 301 7) and to ask for a remedy.
  2. Should no improvement occur within a reasonable period of time, the contract may be terminated.
  3. Claims arising in connection with the event contract have to be claimed by the event participant after the end of the event within one month from Lutz-paddled (address see above). A written submission is recommended.
  4. Undeserved of the notice of defects during the event or assertion after the event are protected by the usual legal regulations.
  5. The event participant is obligated to cooperate within the scope of the legal regulations, to avoid possible disturbances and damage or to keep them low.
  6. 24 months after the end of the event, all claims for validity are barred.
11. Place of jurisdiction
  1. The exclusive place of jurisdiction is the seat of Lutz-paddles; Only German law is applied.
  2. The entire contract is not ineffective by invalidity of individual terms of these terms and conditions.

12. Data Management

  1. The event participant agrees with the registration that his data will be included in the customer file of Lutz-paddles and used for the operation. This is done in compliance with the Federal Data Protection Act.
  2. Lutz-paddling takes the protection of personal data very seriously. We treat the personal data confidentially and in accordance with the legal data protection regulations. The use of our website is usually possible without providing personal data. As far as personal data (e.g. name, address or e-mail addresses) are collected, this is always done on a voluntary basis as far as possible. This data will not be passed on to third parties without your express consent.

  3. We would like to point out that data transmission on the Internet (e.g. when communicating via e-mail) can have security gaps. It is not possible to completely protect the data from access by third parties.

13. Supervisory Duty

  1. The supervisory duty during the execution of the individual actions lies with lutz-paddling or the responsible event managers.
  2. The supervisory duty outside of our actions or the obligation to supervise non-participating participants is borne by one or more of the youth group's supervisors.
14. Canoe Rental
  1. In the case of pure canoe rental without the accompanying staff of Lutz-paddles, the event participant is fully liable for the borrowed material.
  2. Personal injury or material damage during the tour with borrowed material cannot be charged to lutz paddles. The full liability and responsibility lies with the event participant.

15. Dispute resolution

  1. Alternative dispute resolution pursuant to article 14 (1) ODR-Vo and § 36 VSBG:
