General terms and conditions of the company map – Mountain & Adventure Project

 

1. Participants 

 

On guided tours and events of the company MAP-erlebnis.de, anyone can take part, which corresponds to the respective requirements listed in the event descriptions. Each participant (also in case of booking by a third party) is insured by the booking that he will bring the necessary psychological and physical conditions for the action he has chosen. If the physical or mental condition of the participant changes during a tour, it is important to be made aware of this in one of the guides or group leaders. Any existing health restrictions must be communicated to the head of the event before the start of the action! Any adverse effects may result in the exclusion of the participant. The effect of certain medications, alcohol or drugs affects the participant and is therefore considered an exclusion criterion. In this case, persons are excluded from any event and treated as a cancellation on the day of the event.

The tours and actions are carried out by trained and experienced guides and trainers. It is imperative to follow your instructions and requests. Furthermore, the guide of a tour is entitled to exclude persons from an action due to disregard or inappropriate behavior.

 

Until the beginning of the action, a participant may be represented by any third party, provided that it meets the (above) physical and mental requirements. As the beginning of the action we understand the official greeting of the group by the Guiding Guide. Contracting Parties and substitute participants are liable as total debtor for the event price and any additional costs incurred, if these are attributable to the replacement person.

 

2. Conclusion of contract and payment              

                                                                                                    

The programs set on the websites of MAP-erlebnis.de do not constitute a binding offer on the part of MAP-erlebnis.de. By presenting the experiences on the Web pages, MAP-erlebnis.de only asks the customer to make offers (orders).

The offer to conclude a sales contract is the customer's choice by clicking the "Send a Booking" button after completing the booking form, or by making a telephone order or by sending an informal e-mail. If you click on the button "send booking" after providing all relevant data and under acceptance of these GTC as well as the data protection conditions, you provide a binding offer to MAP-erlebnis.de. After placing the order and thus the offer, you will receive a booking confirmation which, among other things, reflects the content of your order ("contract offer") again. You can print them out and you will be encouraged to print out the terms and conditions ´ s on our website at the conclusion of the contract.

 

Only with the written booking confirmation (in the form of email, fax or letter) by the company MAP-erlebnis.de the order is binding for both contract partners. The invoice, which is received at the same time as the confirmation, provides for a full payment of the event price within 14 days of receipt of the invoice.

 

Rebooking is possible at the latest 14 days before the start of the event on an equivalent tour or action. For any rebooking, a flat rate of 10,-Euro per participant will be charged. MAP-erlebnis.de also reserves the right to calculate additional costs, if these are due to the transfer of the action.

 

3. Our Services               

                                                                                   

Unless otherwise agreed, the scope of our offers is determined by the descriptions on our website, our flyers or other advertising materials. With the order confirmation you will receive a list of the relevant services and the most important information for a round Schedule of the action.

 

MAP-erlebnis.de reserves the right to take the tour or activity due to unforeseen circumstances that could endanger the safety of the participants (e.g. too high water level, weather overturning, massive rain, thunderstorms, insufficient skills of the participants etc.) To modify, expand or restrict them. The same applies to official arbitrariness, difficulties with local means of transport or comparable unforeseeable circumstances. We shall be entitled to compensation for any services already provided or to be rendered at the end of the event.

 

The tours and actions are carried out by trained and experienced guides and trainers. It is imperative to follow your instructions and requests. In the event that a participant has to terminate a tour or an action prematurely or for reasons, the additional costs incurred will be borne by him.

 

4. Minimum number of participants         

                                                                                   

Tours, promotions, courses and events are only carried out if the minimum number of participants is reached. If there is something different from the respective tour description, or if there were individual agreements in advance, they apply. If the desired minimum number of participants is not reached, the company MAP-erlebnis.de is entitled to withdraw from the contract up to 14 days before the start of the action or to submit an alternative offer regarding the date and the amount of the participants. Prices already paid can be refunded in full if the lack of participants is not the failure of the participant or the user. Any additional expenses such as hotel costs, holidays, vaccinations, visas, etc. are not and in no case taken over by MAP-erlebnis.de.

 

5. Passport, Visa, customs, foreign exchange, health regulations

 

Each participant is responsible for complying with the above-mentioned requirements and regulations, parents are liable for their children. All disadvantages and costs from non-compliance are at the expense of the participant. By his registration, also by third parties, the participant assures that from a medical point of view there are no doubts about his participation in the event and the respective sporting activities. Costs incurred for vaccinations, visas etc. are borne by the participant himself.

 

6. Changes in performance and prices

 

Changes or deviations of individual event services from the agreed content of the contract, which become necessary after the conclusion of the contract and which have not been brought about by MAP-erlebnis.de in good faith, are only permitted if the changes and deviations are not significant and do not affect the overall cut of the booked event. The printed prices are the same as those known at the point of printing. MAP-erlebnis.de reserves the right to change the price agreed in the contract in the event of an increase in the transport costs or changes in the exchange rates applicable to the event in question.

 

7. Photos and videos made during the tours

 

The company MAP-erlebnis.de or vicarious agents photograph the participants during the tours. These photos are used and disseminated for advertising purposes (print and digital media). In return, MAP-erlebnis.de grants each participant the opportunity to download the images from his tour free of charge on the website of MAP-erlebnis.de. With his booking, the customer of the company MAP-erlebnis.de the right according to § 22 KunstUrhG to display the pictures publicly and to disseminate for advertising purposes.

 

There is no guarantee of quality or number of photos shot during a tour. In case of technical defects, including an empty battery, or loss of the photos, no claims can be made.

 

8. Resignation

                                                                                               

Each participant has the right to withdraw from the event, the course or the tour at any time before the event begins. This should be made in writing for reasons of legal certainty.

 

In case of withdrawal, we will charge the following percentage compensation, based on the total price of the event:

 

In case of cancellation until the 21st day before the start of the event, only costs for a handling fee of 20,-euro per person are incurred.

 

21-16 days Before the start of the event 25% (But at least 20,-Euro per participant)
15-11 days Before the start of the event 50% (But at least 20,-Euro per participant)
10-2 days Before the start of the event 75%   (But at least 20,-Euro per participant)
1-0 days Before the start of the event 100%    (But at least 20,-Euro per participant)

In case of no-show, 100% cancellation fees are automatically charged for the booked services.

 

8.1 Cancellation of appointments with vouchers from experience portals and partners

In case of appointments that have been agreed over or with vouchers or tickets of our experience partners, the validity of a voucher will expire automatically if the guest does not appear. Cancellations will be confirmed from the 14th day before the tour with 100% reversal.

 

9. Liability of the Organizer

 The organizer is liable within the scope of the due diligence of a regular businessman. He is obligated to carry out the event in such a way that it has the assured characteristics and is not tainted with errors which lift or reduce the value or the suitability to the ordinary or in accordance with the contract. In particular, the organizer is liable for:

• Conscientious preparation of the event
• Proper provision of the agreed service
• Description of the service on the homepage
• Selection and verification of service providers

10. Limitation of liability

 

Participation in the tours of MAP-erlebnis.de takes place at your own risk for the participants.
Our liability for property damage is limited to gross negligence and intent. In the event of personal injury we are only liable if we are responsible in any form. Note 11 of the GTC is to be observed in this context.

 

11. Obligation to participate 

 

The participant is obligated to participate in the performance disturbances in the context of the legal regulations, to avoid possible damage or to keep low.
In particular, the participant is obligated to inform the Guide, guide or trainer of his complaint on the spot and without delay. The latter is instructed by MAP-erlebnis.de to provide a remedy if this is possible. If the participant does not culpably indicate a defect, a claim for reduction does not occur.

 

12. Increased risk in outdoor sports

 

All events, courses and tours are prepared by US conscientiously. However, we cannot guarantee a subjectively presented event success. The activities offered by MAP-erlebnis.de have adventure, (extreme) sports or/and experience character. Participation takes place in view of these risks At your own risk. This does not least make the special appeal of our tours.

For all events, courses and tours, it should be noted that there is an increased risk of accidents and injuries in the outdoor sport (danger of falling, avalanches, rock strike, cold damage, weather fall, flood, drowning, eventual death, etc.) which is also caused by Careful and caring care and preparation by our guides and trainers can not be completely reduced and excluded. It should also be noted that in alpine areas, especially in remote regions, due to technical and logistical difficulties, there can be only a very limited amount of rescue and/or medical treatment options. This problem can also have serious consequences for minor injuries or incidents. Here, each participant assumes a certain level of personal responsibility, team spirit, resilience and transparency, as well as an increased level of willingness to take risks.

13. Invalidity of individual provisions

                                                            

The invalidity of individual provisions of the GTC does not result in the invalidity of the entire GTC.

 

14. Place of jurisdiction

 

The participant can only Sue MAP-erlebnis.de at her seat. For actions of MAP-erlebnis.de against the participant, the domicile of the participant is decisive, unless the action is directed to full-time merchants or persons who have moved their domicile or habitual residence abroad after the conclusion of the contract, or whose Domicile or habitual residence is not known at the time of the action, the registered office of MAP-erlebnis.de is decisive

 

15. Other matters 

 

We recommend the conclusion of a travel cancellation, accident, health, liability, mountain and luggage insurance. In the case of groups, the booking company is obligated to forward all relevant information such as general terms, tour information and payment information to each participant in the group.
