Claims for damages, irrespective of the legal basis, are excluded, unless they are based on an intentional, negligent breach of contract by DBD, by a legal representative or vicarious agent.


In addition, the Contracting Parties agree that a claim for damages against DBD is limited to the agreed offer/rent/fee only in the amount, irrespective of the legal basis.


3. Place of jurisdiction
As the place of jurisdiction, the Parties agree on the location of DBD, the competent court Mattighofen, and the application of Austrian law.


4. General Information


4.1
Each participant must be able to swim and have a healthy physical condition.
Participants who are under the influence of alcohol or drugs will be excluded from the event!
DBD basically assumes that every
Participant meets the stated physical requirements for the respective events, rental and is aware of this before the event starts.


4.2
The participant expressly declares that, from a medical point of view, no objection to the

4.3
The stand up paddling is entitled to anyone who has completed the age of 14.
In the case of a minor, the application must be made in writing or orally with the consent of the parent.
This means that the parent is responsible for his or her child for self-sufficient to participate in the courses or in the rental. DBD does not take over underage participants any Aufsichtpflicht, apart from the statutory traffic safety obligations.


4.4
Weather and water-related changes or cancellations (rain, wind, thunderstorms) of the program are exclusively in the decision area of the organizer. In case of non-execution of the event due to these circumstances all participants receive a general terms and conditions SUP –

1. General
Driftwood by Danique (DBD) concludes contracts and provides the services exclusively under these general terms and conditions.
Conflicting terms and conditions of the Contracting Party are only effective if they are acknowledged by the DBD. By placing the order or renting the SUP boards by the contracting partner/tenant, the GTC of dbd shall be deemed accepted.


2. Terms and Conditions


2.1
The use of the SUP boards and accessories for tours/training and rental is at your own risk. Rental is only done on presentation of a valid identity document.


2.2
In the case of minors (up to 14 years), the rental contract has to be signed personally by a legal guardian. The rental can also be

The tenant undertakes to treat the rented objects with care. Damage and contamination,

The basis of the business relations is the respective offers, the rental prices or the various packages, in which all agreed services (scope of service) and remuneration are recorded.

The amount of the rental is determined by the applicable tariffs. The rental prices depend on the current price list.


2.6
The liability is exclusively based on the written agreements. All claims that are not expressly granted herein, including
Coupon or a new date for the program. There are no further claims!


4.5
In the event of a health-threatening situation due to weather conditions (rain, wind, thunderstorms), DBD is entitled to cancel tours and trainings. In this case, the tenant is not entitled to reimbursement of incidental costs (arrival, hotel accommodation, etc.).


4.6
The tenant has the obligation, even in the event of sudden changes in the weather situation, to return the rented property to him completely within the opening hours.


4.7
If, for whatever reason, the participant does not take any action, no refund will be made.


4.8
Issued vouchers are
Date of issue 1 year valid. A cash alternative of issued vouchers is not possible.


4.9
Each participant has to follow the instructions of the Instruktorteams!


4.10
The participant is particularly reminded of the following: The stand up paddling is a risky sport, therefore there is an increased risk of injury, both for one's own person and for third parties.


4.11
DBD assumes no liability for dangers that are inevitably associated with stand up paddling. The participant takes these dangers into account. Furthermore, DBD does not accept any liability for damages incurred by the participant during the exercise of the paddle by the fault of other students or third parties.


4.12
DBD does not assume any liability for loss or damage to the ownership of the participants. The participant must treat the material provided to him carefully and properly. The participant is liable in case of grossly negligent damage and loss.
The participant is obligated to immediately report any Leistungstörungen that have occurred.
The registration for a course or rental can be done electronically by e-mail/website or by telephone. It is also carried out by the participant for all participants listed in the registration, for whose contractual obligation the applicant as for his own obligations.


4.13
The tenant/customer agrees that the photos and videos recorded during the activities of the instructors or staff, on which the tenant/customer is identifiable, may be used for advertising purposes without further consent.


4.14
No liability will be assumed by the landlord for lost or damaged valuables.
