Terms of Service
1. Registration:
Bookings can be made orally, by telephone, over the Internet or in writing and by fax; In any case, these are binding declarations. For bookings made over the Internet, the booking, after receipt of the travel confirmation, is recognized by the customer with the payment of the deposit. For BST, the travel contract is binding if the booking and the travel price are confirmed in writing within 14 days after registration. The applicant shall be liable in addition to the participant for the fulfilment of the obligations of the persons registered by him.
2. Payment & Booking Confirmation:
With the receipt of the written confirmation, including the Insolvenzsicherunsschein by BST, a deposit of 10% of the travel price, but at least 30,-Euro per person is due. The full travel price must be received and credited by bank transfer to our bank account at the latest 21 days before the start of the journey, or handed over to the travel agent. The travel documents will be sent immediately.
3. Obligations of the tour operator:
BST is obligated to carry out the journey in such a way that it has the assured characteristics and is not tainted with errors that remove or reduce the value or suitability of the entire journey.
4. Obligations of the traveller:
The traveller is obliged to do what is necessary in order to prepare, carry out and handle the journey in accordance with the contract. If the traveller culpably violates these obligations, he is obligated BST to compensate for the resulting damage
Participants who have not yet completed the age of 18 can only take part in the company of an adult who is also responsible for the liability.
5. Services and Prices:
If the journey is to be entered later than four months after the confirmation of the order, BST reserves the right to increase the price of fuel and, in particular, the exchange rate fluctuations, To raise the agreed travel price accordingly. BST must notify such a price increase in writing no later than 4 weeks before the commencement of the journey, after this date, price increases are excluded. The customer has the right to withdraw from the contract in the case of price adjustments higher than 10% of the travel price within one week of notification by BST.
6. Cancellation or cancellation of the traveler:
If the customer withdraws from the travel contract (due to the securing of evidence, travel resignations should always be made in writing) or if he does not enter the journey without withdrawing from the travel contract, BST may demand reasonable compensation for the travel arrangements made The following percentages are relevant:
A) Declaration of cancellation up to 40 days before the commencement of the contract: 10% of the travel price, at least 30,-Euro per person.
b) Declaration of resignation after the 40th day, but until the 15th day before the contractual planned start of the journey: 30%, at least 30,-Euro per person.
c) After the 15th day: But until the 6th day: 40% of the travel price, at least 40,-Euro per person.
D) After the 6th day: up to 70% of the travel price
e) from 24 hours before departure: up to 100% of the travel price
7. Termination of the contract by BST:
Before the start of the journey BST can withdraw from the contract if:
A) The traveller is in arrears with the payment of the remuneration
b) If the minimum number of participants is not reached (the required minimum number of participants is to be given to the corresponding travel histories)
In case a, BST may request compensation from the customer in accordance with clause 6. The amount of the compensation shall be measured after the date on which the cancellation is received by the traveller.
In case b the deposited amounts are refunded, further claims of the customer are excluded.
After the commencement of the journey, BST may terminate the contract if the traveller disturbs the execution of the journey in a sustainable way irrespective of a warning by BST or his vicarious agents or if he behaves in such a way contrary to the contract that the immediate termination of the contract is justified. In this case, BST reserves the right to the agreed remuneration minus any expenses and proceeds saved by other use.
8. Termination of force Majeure:
If the journey is considerably more difficult, endangered or impaired as a result of the contract conclusion of unforeseeable force majeure, both BST and the traveller may withdraw from the contract. In this case, BST may demand compensation for the travel services already provided and to be carried out until the end of the journey, in accordance with § 471 BGB.
9. Warranty/Mitwirkungspflicht:
A) If a service part of the booked trip is not provided in accordance with the contract, the customer is entitled to demand remedy. Complaints must be communicated immediately to BST by telephone, fax or the local BST tour guide. If this communication is not culpable, warranty claims are excluded. In the case of warranty, we can remedy this by providing an equivalent replacement service.
b) Each participant is responsible for compliance with passport, visa, customs and foreign exchange regulations. BST is not liable for visa procurement.
c) Warranty claims must be asserted at BST no later than one month after the expected end of the reservation. Claims received later are not recognised.
D) With regard to the rights of the Traveller, according to the general rules cancellation of the contract, to demand reduction of the travel price or compensation, it is agreed that the maximum liability by BST to three times the travel price according to § 651 H BGB Limited. Furthermore § 651 H para 2 BGB applies.
10. Exclusion of Liability:
The organizer does not accept any liability for damages that the traveller inflicts on himself, the entrusted equipment or other persons during a journey or is dealt with by him. This also applies to devices that are directly related to the journey.
11. Bus Transfer:
Should a bus not be at the meeting point at the specified time, which is sometimes not to be avoided by traffic congestion, etc., the customer has the possibility to inquire about the length of the delay by telephone. In no case should the meeting point be abandoned. If the bus is not reached, there is no entitlement to reimbursement of travel costs.
12. Travel agency:
Bright Side Tours does not accept any obligations in the event of a travel agency to reimburse the customer for the services performed by the respective tour operator. These must be requested by the customer himself at the organizer. The general terms and conditions of the respective organiser are valid, which we are happy to send upon request.
13. Ineffectiveness:
The invalidity of individual provisions of the travel contract does not result in the invalidity of the entire travel contract. In place of the ineffective regulation, effective, which comes closest to the will of the parties.
14. Special requests and single room arrangements:
Special requests, which are not foreseen in the program and are desired by the travellers, can be arranged by BST. The service providers are liable for the fulfilment and lack of freedom of such special requests, not BST. Claims for damages by BST to the service providers are assigned to the traveller. The booking of single rooms, which are only limited available for all travel, is considered as a request. Here BST arranges the booking to the designated service carrier. Should a booked single room not be available, BST will refund the proportionate surcharge and any claims for damages to the service providers will be ceded to the traveller.
15. Insurance:
In order to avoid costs arising from cancellation or cancellation, BST recommends the conclusion of a travel cancellation insurance. In addition, policies for foreign health insurance, baggage insurance and accident insurance, etc. can be concluded at BST or the intermediary travel agency at original prices.
16. Canoe Tours
For booked canoe trips the rental conditions for canoe trips are also valid. These are published on the Internet and can also be requested.
