General terms and Conditions
Terms
Our entire offer, whether board rental, course, day tour, group tour etc. is described in our terms and conditions as an event.
2. General Information
2.1. Use of the SUP boards and accessories is at your own risk.
2.2. Participation requires that the participant
• Can take part from a medical point of view (Augeschlossen e.g. epilepsy)
• Can swim and stay afloat for at least 15 minutes and can return to the Board on its own.
• Is not drunk or has consumed other intoxicating means or drugs.
2.3. If the participant is a minor, a statement by the legal representative is required that the under 2.1 and 2.2. Certain conditions are met by the minor. This declaration is issued at least implied by the consent of the parent to register for the event, including the general terms and conditions.
2.4. The rental of our SUP boards is only done on the basis of the personal details (name, address) and on presentation of the identity document or other valid documents.
2.5. The tenant undertakes to treat the rented objects with care. Damage and contamination will be removed at the expense of the tenant. At the specified pick-up/return date, the tenant has to return the rented objects completely and personally to the landlord. In case of loss and/or damage of the rented property, tenants and users are the total debtor. The tenant is to be filled with compensation, even if the polluters are third and natural forces.
2.6. The tenant takes over the full liability of the rented objects after acceptance/takeover. If the tenant makes use of the renter's services for several participants, he shall remain liable to the landlord in all respects. In particular, he is liable to the landlord for the other participants.
2.7. The rental of SUP boards is exclusively carried out to persons who have been shown a basic course SUP at us or another recognised SUP school or who have visited the "basics" such as forward-/Steuer-/Stoppschlag and Master the necessary basic knowledge.
3. Registration
Registrations can be done online, by e-mail, by phone or in persona and are valid after confirmation by the organizer. With the registration, the terms and conditions are accepted and the contract becomes binding as well as if applicable cancellation policy.
4. Payment
4.1. The agreed payment for the event will be made in advance by bank transfer, in cash or online via PayPal. If a payment is arranged by invoice, it is payable immediately after receipt of the invoice and before the event. The rental prices are payable at the expense.
4.2. The minimum rental period is 1 Sunde (exceptions possible by arrangement). Thereafter, each additional half-hour will be charged. An early return does not entitle you to recovery of the rental price.
5. Safety and security
5.1. The tenant/participant confirms that the users of the SUP boards are without exception swimmers. A life vest is obligatory for non-swimmers. Own vests are welcome, otherwise they are to be rented. Users are alerted to the wearing of life jackets because of the risk of accidents. For safety reasons, children are allowed to run up paddling with us only from the age of 6 years.
5.2. The wearing of life jackets is obligatory for children up to the age of 16.
5.3. Tenants and participants are also obliged to carry a line (on the lake). This is included in the rental price.
5.4. For river tours and courses Special safety regulations apply, such as the fulfilment of the conditions according to 2.1.-2.3., also the wearing of a white water helmet, a (whitewater) life vest, firm, ideally special whitewater shoes (with sole), If necessary, but also from sneakers.
6. Reservation/Cancellation
6.1. All reservations are binding.
6.2. Resignations of events are possible free of charge if an equivalent replacement (e.g. date shift) can be made.
6.3. Withdrawals from the registration date up to 14 days before tours-/Kursbeginn require 20% handling costs, resignations of less than 7 days costs of 50%, cancellations up to 48 hours before the start of the course will not be reimbursed.
6.4. Bavarianwaters Chiemsee may take advantage of the right of withdrawal if the scheduled execution of the event is significantly impeded, endangered or impaired by unforeseeable, exceptional circumstances, as in cases of force majeure, Thunderstorms, storms, cold, particularly bad weather, low or too high water levels, illness of the SUP instructor or not reaching the minimum number of participants. The customer will then be entitled to a full refund of the amounts already paid. In this case, the participant is not entitled to reimbursement of incidental costs (arrival, hotel accommodation, etc.). This also applies in the case that a river trip does not take place due to low or too high water levels or has to be moved to another water.
6.5. An alternative date or the issuance of an event voucher is possible.
7. Instructions from instructors and SUPGuides
7.1. Follow the instructions of the employees of Bavarianwaters or persons working for us.
7.2. For events, the instructor/SUP-guide must always follow. Participants who have a lasting disturbance to an event, other participants or third parties, who behave in breach of contract or who deliberately endanger themselves and others, may be excluded from further participation. Payments made will not be refunded.
8. Equipment
8.1. Our boards and accessories are in perfect condition and are regularly checked for defects and damage.
8.2. In the event of damage or loss (e.g. improper use, transport, including transport by third-party or defective fuse), the tenant is fully liable for the time value of the material for repair or replacement. The landlord assumes no liability for damage to third parties and improper handling.
The tenant is obligated to return the board and accessories cleanly. Otherwise, cleaning costs of 7.00,-euro will be charged.
In the event of accidents or accidents, the organizer must be informed immediately and instructions for further conduct must be awaited.
9. Complaints
The participant is obligated to inform the organizer immediately of any complaints and defects. The latter undertakes to provide a remedy if this is possible. Unreported damages are considered to be intentional and (also subsequently) invoiced. If damages are not reported, the tenant can also be held liable for consequential damages (e.g. failure of the board due to repair). Normal wear and tear are excluded from the compensation obligation.
10. Duty of supervision, conduct, due diligence
10.1. Driving bans and private bids in areas of non-public land must be adhered to.
10.2. Waste must be collected in garbage bags to be brought in and disposed of in public waste bins or household waste during or after the event. All rest areas must be left completely clean.
11. Disclaimer of Liability
Bavarianwaters Chiemsee is not liable as a rental and course station for damage to persons, property or transport. No liability is assumed for lost or damaged valuables at the Lido Harras/Prien or in parked vehicles. The organiser shall be liable contractually for any damages incurred by the user or third parties in connection with the hiring of the rented objects. The used person will exempt the landlord from claims of third parties due to accidents. The user releases the landlord from all claims arising from the violation of laws, regulations or other regulations in connection with the use of the rented objects by him or a third person.
12. Ineffectiveness
If one or more provisions of these general terms and conditions are or become ineffective, this does not affect the validity of the remaining terms. The ineffective regulation shall be replaced by an effective one which comes closest to the economic and legal will of the Contracting Parties.
13. Data Protection/Data usage/image usage
We use your stock data exclusively for the processing of your event booking. All customer data is stored and processed by us in compliance with the relevant regulations of the Federal Data Protection Act (BDSG). You have the right to free information, correction, blocking and, if necessary, deletion of your stored data at any time. Please contact us via e-mail. We do not pass on your personal data, including your house and email address, to third parties without your explicit and at any time revokable consent. The participant agrees with your booking that you will be photographed during your stay at events and sports activities and these photographs may be used as part of the marketing of Bavarianwaters Chiemsee. This consent can be revoked at any time in writing via e-mail. In view of the registered data of the participants, Bavarianwaters Chiemsee undertakes to comply with the data protection and media law regulations. In particular, the data are treated confidentially. The participant may revoke the consent in writing at any time. Material used until revocation (flyer, etc.) will remain in circulation until the material has been consumed.
14. Place of performance/legal venue
German law applies. The venue and place of performance is the host's registered office.
