General terms and Conditions

1. Participants
At the events, events and activities offered by SAYAQ Adventures GmbH, anyone who meets the conditions of participation can participate. The participant confirms that he has the necessary physical and psychological requirements for the selected event. Each participant is obligated to participate in the instruction carried out by the employees of Sayaq Adventures GmbH and to comply with the safety regulations. Should the participant withdraw from this instruction, it is up to the staff of Sayaq adventures to exclude him from the event. Persons who are under the influence of drugs, drugs or alcohol will also be excluded from the event.

2. Conclusion of the contract and payment
The registration for a selected action can be made in writing, by phone or in person. The booking contract is concluded and becomes binding in force by sending our booking confirmation. The persons who have accepted the application are in the contractual obligation for themselves and all other registered participants. SAYAQ Adventures GmbH sends the invoice of the booked event at the same time as the booking confirmation. The invoice should be settled in the indicated due date, otherwise a reminder fee of €7.50 will be charged after a pre-sent payment reminder.

3. Our Services
The scope of our services is exclusively determined by the service description in the booking confirmation and the invoice. SAYAQ Adventures GmbH reserves the right to modify the program of the event, due to official arbitrariness, difficulties with local conditions (such as transportation), unforeseeable circumstances or similar, if necessary, to Expand or Restrict.

4. Performance and price change
SAYAQ Adventures GmbH reserves the right to adjust the event price up to the 20th day before the event with a previous calculation. It is possible to increase the price due to increased transport costs, changes in the exchange rate or other services.

5. Resignation
Cancellation is only possible in writing or by telephone. In case of unannounced non-appearance, the price must still be paid. Only in case of cancellation can the payment obligation be reduced by proof of valid reasons (e.g. with the presentation of a certificate of the prevented participant). This also applies if there is a delay of more than 30 minutes, and then the event may no longer be guaranteed. For cancellation of the event the following prices apply:-from 30 days before the date of the event 30% of the price-from 20 days before the event 50% of the price-from 5 days before the date of the event 80% of the price. Until the start of the event, the participant may be replaced by a third party, provided that he meets the above mentioned conditions of participation and requirements. In this case, the Contracting Party, the original registered and the replacement participant shall be liable as a total debtor for the event price and any additional costs incurred.

6. Force Majeure
The participants are aware that the event takes place primarily in the open nature and can therefore only be carried out with suitable weather conditions (i.e. not during storms or thunderstorms); It may therefore be necessary to cancel an event, if necessary also at short notice. In this case, SAYAQ Adventures GmbH offers participants a date shift, a replacement program or a voucher for the booked service.

7. Liability
The participants are aware that the event in the area of outdoor sports a certain accident and injury risk. SAYAQ Adventures GmbH is liable under the legal provisions for personal injury. Liability for damage to property and personal injury exists only in the case of intent, gross negligence or negligent breach of an essential contractual obligation of SAYAQ Adventures GmbH, its representatives or vicarious agents.

8. Final provisions
The invalidity of the aforementioned provisions does not result in the invalidity of the entire GTC. For actions by Sayaq Adventures GmbH against participants who do not have a general place of jurisdiction in Germany, as well as persons who are not aware of their domicile or habitual residence after the conclusion of the event contract, our registered office shall be deemed to be an agreed Place of jurisdiction. Extensions of our contractual services only come into force through a written confirmation. Verbal side agreements with employees are not legally valid.
