Terms and conditions of business and participation

 

1. Anyone who meets the aforementioned requirements can participate. For minors, the written consent of the parent is required. Participants who cannot swim must specify this at the booking and wear extra non-swimmers vests. The participant declares that from a medical point of view there are no doubts about his participation. 

2. With the registration, our conditions of participation are recognized. The registrations are processed according to the date of receipt. We recommend to book an appointment tour no later than 10 days before tour. Subsequent applications will be considered where possible. With the written registration the desired contract becomes binding. 

3. Payments must be made to the appropriate account before the start of the event or paid in cash. Prices are subject to change.

4. Withdrawals from the registration date up to 10 days before the start of the tour require a handling fee of 20% of the price; Withdrawals of less than 10 days a fee of 50%. In case of cancellation from two days before tour a 90% fee will be charged. 

5. The tour operator may avail himself of the right of withdrawal if the scheduled execution of the journey is considerably more difficult, endangered or impaired by unforeseeable exceptional circumstances, as in cases of force majeure, sickness of the Tour leader or even if the minimum number of participants is not reached. The customer shall then be entitled to full refund of sums already paid. 

6. Changes in the planned itinerary cannot always be ruled out due to the nature of the tours. In the case of high or low water or organizational necessities, a replacement programme may be established by the organizer. Especially for high or low water, the service you have booked can be moved to another location.

7. We are liable for the conscientious preparation and execution of the tours and courses, the careful selection and control of the ladder and the correctness of the service descriptions. We assume no liability for damage to persons or property during the journey, the course operation, the tour or during the transport of boats and material. We do not accept any liability for our safety tonnes and boxes. We recommend a 3x fuse: valuables in plastic bag, then in box or ton, additionally in bag. Participation is at your own risk. 

8. Kenterrisiko: We try to advise you according to your ability and your requirements, which you call us so that you can do your canoe trip without stress as much as possible. If you choose a rental service on our small rivers with flow, it can come to Kenterungen with considerable mountain effort in case of lack of ability. We therefore ask you to understand the following rules: In the event of extraordinary Kenterungen at your rental service and subsequent salvage by us, costs of €50 will be charged.

9. Delay: In case of delays of more than 15 minutes upon commencement of the tour, we charge a fee of €20. At more than 30 minutes delay €30, at more than 60 minutes €50. With more than one hour delay we can no longer guarantee the tour. Boat Tax: The time information for our route tours is calculated so that you can do a comfortable tour without time-press. In the event of a delay of more than 30 minutes, we charge a fee of 
€30, at more than 60 minutes €50.

10. Other carriers may act as organisers within the framework of cooperation with us. In this case, the business and insurance conditions of these institutions shall apply. 

11. Equipment can be borrowed from us. If the rental equipment is lost, the participant is liable for the fair value. Participants with their own equipment need a WW boat with grip loops, paddles, buoyancy, life vest and helmet, especially for whitewater tours or courses. Thermal protective clothing (neoprene) should be carried. 

12. Instructions of the course or tour leader must be provided in each case. It is expected that nature will be handled with care. In the case of grossly improper conduct, which endangers the reputation or integrity of the participants or the organizer, a participant may be excluded from the further course after admonition by the tour leader. 

13. Alcohol consumption is prohibited for safety reasons before and during a canoe or other event. The Tourleitung reserves the right to exclude obviously intoxicated participants from the event.

14. Boat loading requires the cooperation of the participants in the team. 

15. The customer is obligated to inform the Tour management immediately of any complaints. The Commission is responsible for providing a remedy, if possible. If the customer culpably fails to indicate a defect, a claim for reduction does not occur. 

16. The invalidity of individual provisions of the organizer does not result in the ineffectiveness of the entire contract. Please refer to the BGB for all other information.
