The general terms and conditions listed herein are part of any contract concluded between the company Outdoordirekt, Inh.: Christian Zig, Stemmenkamp 79b, 59368 Werne (hereinafter Outdoordirekt) and you as an event participant.

  1. Registration and conclusion of contract
    1. The registration for our events can be made in writing, by post, fax or e-mail and represents a binding offer of the event participant which is valid for four weeks. This application must be made via a booking form (online or by post or by mail). Informal bookings are also recognized as soon as they have been confirmed by Outdoordirekt in writing or orally.
    2. Outdoordirekt accepts the booking in the form of a booking confirmation. This can be done orally or in writing. Upon conclusion of the contract, the event participant will generally receive a written confirmation of the booking and other travel documents. However, if the booking confirmation differs from the offer of the event participant, this is a 10-day offer by the company Outdoordirekt and can be accepted by payment of the deposit.
    3. If several participants are registered in a registration, the notifying Party shall be liable for all obligations of the latter.
    4. Our prices are always connected with an additional (per group, per person or per event duration, per day). This varies depending on the event and can be Outdoordirekt from the brochures or the offer of the company. Age-related benefits always refer to the completed year of life.
  2. Payment Terms
    1. Domestic events: After receipt of the booking confirmation/invoice, payment of the total amount is due within 7 days.
    2. Travel abroad: A deposit of 25% of the total event price must be paid within 7 days of receipt of the invoice. The balance is payable, unless otherwise agreed, no later than 31 days before the start of the event.
    3. Payment must be made by bank transfer (Christian Zig; Account No.: 248336; Sparkasse Krefeld; Bank Code 320 500 00). The participant name and the invoice number must be specified.
    4. If the balance is not received in time on the account, the contract can be terminated after a one-time reminder and deadline. In this case, the participant will be charged with cancellation costs (see 3.1).
    5. For bookings made 4 weeks before the start of the event, the total amount will be due immediately after the booking confirmation.
    6. If you use the Frühzahlerrabattes, the total amount must be credited to Outdoordirekt within 7 days after the invoice has been created. If this is not the case, the Frühzahlerrabatt is disapproved and the difference is invoiced to the participant.
  3. Rescission or rebooking by the participant
    1. The event participant can withdraw from the event at any time. This must always be done in writing. The cancellation costs incurred are calculated as follows:
      • After booking, up to 31 days before the start of the event 20% of the total cost of the holiday, at least 25,-euro,
      • Up to 22 days before the start of the event 30% of the total cost of the
      • Up to 15 days before the start of the event 50% of the total cost of the
      • Up to 8 days before the start of the event 80% of the total cost of the
      • Up to 1 day before the start of the event 90% of the total cost of the
      • On the day of arrival or later 100% of the total travel costs.
    2. The transfer of an event after the booking to a different date is in principle only possible after written or verbal agreement with Outdoordirekt. It will only be effective after written confirmation, by email or by post, by Outdoordirekt. There is no entitlement to a rebooking, it is at the discretion of Outdoordirekt and is a goodwill, for which in any case a handling fee in the above-mentioned amount is incurred:
      • For domestic courses: at least 10,-Euro per transfer
      • For trips abroad: at least 25,-Euro per transfer
  4. Unused services
    1. If services are not used due to illness, early departure or other reasons for which Outdoordirekt is not responsible, there is no entitlement to reimbursement of the event costs. Saved expenses, which are refunded by third-party Outdoordirekt, will be paid back to the event participant.
  5. Resignation and termination by Outdoordirekt
    1. Disturbance during the event: an event can be terminated without notice if the event participant still significantly disturbs the Schedule of the event even after a warning. Immediate exclusion is also possible if the event participant endangers the group or does not comply with clear instructions from the event attendant. Outdoordirekt reserves the right to the total price of the event. Saved expenses, credited services of third parties or benefits drawn from this event will be credited to the event participant.
    2. With the booking, the event participant accepts the conditions for participation in the booked event. These are included in the description of the course. An event can be terminated without notice if the event participant does not meet the requirements. Outdoordirekt reserves the right to the total price of the event. Should it be possible to switch to an event adapted to the requirements of the participant on the spot and at the same time, without the disadvantage of the other event participant, Outdoordirekt offers this. There is no entitlement to this change, it is at the discretion of Outdoordirekt and represents a goodwill.
    3. Minimum number of participants: if the minimum number of participants of an event is not reached, Outdoordirekt can cancel these 7 days before the start of the journey. It is at the discretion of the organiser whether the number of participants is sufficient. A replacement for the failing event may be required if it is not associated with any additional expenses for Outdoordirekt.
  6. Services/Changes in performance
    1. The services result from the individual event descriptions or a written offer of the company Outdoordirekt in connection with the booking confirmation
    2. In case of significant changes in the services, the event participant may withdraw from the event or take a replacement trip. However, this right must be exercised immediately when the change is made known.
    3. Changes in performance that remain within a reasonable framework, are not wilfully caused by Outdoordirekt and are not a significant deviation are permitted. However, these are to be communicated to the event participant immediately upon becoming known.
    4. If, at the request of the event participant, changes are made to the event, they may be linked to a rebooking fee. The amount of the rebooking fee is determined according to the expenses.
    5. If a call for proposals refers to possible problems (e.g. fluctuating water levels of different rivers such as Victory), Outdoordirekt can show alternatives at the conclusion of the contract. If an alternative is agreed, it is binding.
  7. Force Majeure
    1. In the event of unforeseeable force majeure (floods, thunderstorms in canoeing events, etc.) which significantly disrupt or endanger the event, Outdoordirekt may propose an alternative programme or cancel the event.
    2. The event participant can also cancel the contract in this case.
    3. Outdoordirekt may demand compensation for services already provided or to be rendered.
  8. Liability
    1. Events associated with special risks are at your own risk. We are only liable in case of gross negligence and intent on the part of the organizer.
    2. For damages that are not bodily damage, the liability of the organizer is limited to the triple travel price, if the damage was not caused by gross negligence or wilful intent.
    3. Outdoordirekt is not liable for performance disturbances or damages which are indicated in the prospectus or in the offer as external services and have only been mediated by us.
  9. Customs, passport and other provisions for your course area
    1. The event participant has to ensure that there are special provisions on customs, foreign exchange, visas, passports, etc. depending on the venue. The event participant is responsible for the observance of all provisions, including those not mentioned by us. All the disadvantages arising therefrom are at his own expense.
  10. Contract Obligation and notes
    1. Should an event not be carried out according to the contract or if defects occur during the booked event, they shall be immediately forwarded to the event management or Outdoordirekt (Christian Zig, Stemmenkamp 79b, 59368 Werne, tel.: 0171 6275873) and to ask for a remedy.
    2. Should no improvement occur within a reasonable period of time, the contract may be terminated.
    3. Claims arising in connection with the event contract must be submitted to the event participant at the end of the event within one month from Outdoordirekt (address see above). A written submission is recommended.
    4. Undeserved of the notice of defects during the event or assertion after the event are protected by the usual legal regulations.
    5. The traveller is obligated to cooperate within the framework of the legal regulations, to avoid possible disturbances and damage or to keep them low.
    6. 12 months after the end of the event, all claims of validity are barred.
  11. Legal venue
    1. The exclusive place of jurisdiction is the seat of the company Outdoordirekt; Only German law is applied.
    2. The entire contract is not ineffective by invalidity of individual terms of these terms and conditions.
  12. Data management
    1. The event participant agrees with the registration that his data will be included in the customer file of Outdoordirekt and used for the operation. This is done in compliance with the Federal Data Protection Act.
  13. Supervisory duty
    1. The supervisory duty during the execution of the individual actions lies with Outdoordirekt or the responsible event managers.
    2. The obligation to supervise outside our activities or the obligation to supervise non-participating participants is carried out by one or more of the supervisors of youth groups.
  14. Canoe Rental
    1. In the case of pure canoe rental without accompanying staff of Outdoordirekt, the event participant is fully liable for the borrowed material.
    2. Damage to persons or material during the tour with borrowed material cannot be Outdoordirekt. The full liability and responsibility lies with the event participant.
  15. Dispute resolution
